Durable Medical Equipment Fraud

South Florida DME Fraud Lawyer

Companies that provide durable medical equipment (DME), including oxygen tanks, nebulizers, catheters, wheelchairs and other equipment, have become more deeply scrutinized in recent years by federal and state government agencies. These companies may be accused of prescribing or billing for unnecessary medical equipment, which is a form of health care fraud. Durable medical equipment fraud has serious consequences for the owners of these companies and it is important to find experienced criminal defense for these charges.

I am attorney Jose M. Quinon, and I have represented the owners of durable medical equipment supply companies against charges of health care, Medicare and Medicaid fraud. For more than 25 years, I have represented a wide range of clients against charges of health care fraud and other criminal offenses in the state of Florida, Puerto Rico and across the United States. I will carefully review your case and help you understand your best options for defense.

Experienced Defense for Durable Medical Equipment Fraud

When a patient seeks medical treatment for an injury or illness, a doctor or other medical professional may legitimately prescribe equipment or supplies to treat that condition. A durable medical equipment company will often supply that equipment unless it is already on hand at the clinic, hospital or other medical office. The DME supplier will bill Medicare or the insurer and will receive payment for any prescribed equipment or supplies.

However, simple mistakes in this process can cause problems and what began as a legitimate, legal transaction can be viewed as fraudulent by government agencies. DME fraud can occur in a variety of ways, including:

  • Billing for more equipment than was received by the patient
  • Overbilling for medical equipment and supplies
  • Altering or fabricating wholesale invoices
  • Fake letters of medical necessity
  • Medical equipment prescribed to fictitious people and billed to insurance companies

In these and other cases, federal and state government agencies aggressively prosecute these crimes and work to secure severe punishments for the alleged offenders.
